After nearly five years of legal proceedings, the High Court has dismissed the corruption case against former Ghana Football Association (GFA) President Kwesi Nyantakyi on the grounds of the absence of a witness to testify.
The case originated from the Number 12 exposé by renowned investigative journalist Anas Aremeyaw Anas and Tiger Eye P. I, which alleged corruption within Ghana’s football administration. The documentary, released in 2018, led to Nyantakyi’s resignation and a lifetime ban from FIFA, which was later reduced to 15 years.
The legal battle faced a major hurdle when the court ruled that Anas could only testify if he revealed his face in court. Known for wearing a mask to conceal his identity, Anas refused to comply with the court’s directive. As a result, the prosecution lacked a key witness to support the case, leading to its dismissal.
However, the decision raises a few questions about the future of similar cases which require the protection and anonymity of witnesses or journalists.
The dismissal of the case has sparked mixed reactions. Some argue that the ruling highlights flaws in Ghana’s legal system when handling cases based on undercover journalism, while others see it as a victory for due process and the rights of the accused.
As of now, neither Anas nor Tiger Eye P.I. has issued an official statement regarding the court’s decision. Meanwhile, Nyantakyi’s legal troubles appear to have come to an end, barring any further appeals or new evidence.
